>> Meat stabbing case late this afternoon,
a judge denied Carmelo Anony's request
for a new trial. Thanks for joining us
everybody. I'm Terresa Woodard. Anthony
in June was convicted of murdering
fellow Frisco ISD student Austin Metaf.
The stabbing happened in April 2025.
Today's ruling came down about 3 hours
ago. In a one-page document, the judge
said upon reviewing the motion, the
record, the evidence and argument, the
briefs, and relevant case law. The court
has determined the motion should be
denied. Senior crime and justice
reporter Rebecca Lopez has been in the
courtroom following this case really
from the very beginning. Rebecca, you've
been talking to both sides since this
decision came down. What are you
hearing?
>> So, Teresa, this decision basically
leaves Carmemelllo Anony's murder
conviction and 35-year sentence in
place. And tonight we are hearing
reaction from Anony's attorneys and the
Austin Metev Foundation. The judge
denied Anony's motion for a new trial
after two days of testimony. Anony's new
attorneys argued his right to a public
trial was violated because the original
judge did not provide an overflow
courtroom and more access for the
public. They also argued an informal
agreement between prosecutors and
Anony's former attorneys fell apart,
affecting the decision not to have
Anthony testify. The two sides had
agreed to keep damaging information
about both Anthony and the Medv twins
away from the jury and focus only on
what happened the day Austin was
stabbed.
>> Wow. There you go, guys. Denied. Denied.
Denied. These guys, they went in there,
they got the judge taken out of out of
the the new judge may have been friends
with the old judge. I don't know. But
this is a denial that has shook up the
judicial system when it come down to the
Car Carmelo Anthony family. OG, are you

>> Well, I told you from the beginning that
uh their their merits were weak and I uh
denied access to a public trial. He
didn't the judge didn't deny access to a
public trial. the people came in who he
wants in the courtroom is the judge's
discretion. Uh the deal that the
prosecution made with the defense to
only talk about that time. That's
discretionary. We should the the motion
should have been on his civil rights,
his rights being violated, which they
didn't bring up any of that. From the
time that the prosecution
had the teen witnesses on there and he
asked them for a conclusion, do they
think that was murder? That's not what
you ask a witness. That's not what a
witness a witness is not a professional.
They they can't deduce what's man's
slaughter and what's murder. So for me
to ask you, do you think this was man
smart or murder? And I say it's murder.
That's tighten the jury. And when the
judge did not uh sanction the the
prosecution on that and you didn't and
the um defense didn't uh ask that it be
stricken. That's called under Lel versus
the state of California. It's called
ineffective aid and counsel. So yeah.
No, they den they denied stuff because
it had no merit.
>> Well, they I I think they knew that that
this was going to be an uphill battle.
Just because you get a new judge in the
same county that was working side by
side this other judge the whole time.
What make you think things are going to
change so uh instantaneously. This is a
uphill battle.
>> Yeah. That's just like they telling uh
well we going to fire uh Boss Char, but
we going to hire OG. It's still going to
be the same rules.
>> Yeah. Well, yeah. What you what you
think the difference going to be?
>> It ain't going to be no different. And
that's the whole game.
>> So, you have to you have to deal with
merit. And when you go in there, that
was a a those were were
weak uh motions to begin with because
with with those kind of motions, you
know, that's discretionary. That's
that's not something that holds standard
that would show that it would be any
different on the outcome of the case.
How many people in the audience? What
was that going to sway the jury?
>> It's sad because it's sad because they
didn't take long to do it either.
>> No, not long at all. Because it was
already embedded in their mind. When you
have three witnesses, teen witnesses
that claim that they were on the scene
and when you testify to what you know
happened and when in the conclusion I
asked you, do you think that was man
manslaughter? Do you think that was
accident or intentional? And you say
it's intentional. So what is the jury to
think?
>> Yeah. Judge Michael Chitty, that's his
name, Michael Chitty denied the trial
retrial motion in a halfpage order
following a two-day hearing this week
near Dallas citing reviewing the
evidence arguments he did not elaborate
on. He didn't even give them an a reason
why
>> Russell Wilson Anony's attorney said the
defense would appeal, you know, but but
but he didn't give him no kind of
explanation on it. Uh Mr. Witty was not
trying to pity nothing that was going on
with this trial. And it's like,

>> But you can't fault you can't fault the
judge because the merits were low.

>> These guys have been to school forever.

and they did what they felt they had to
do. This is a team of legal attorneys
that have been in this forever and you

did it this way.

court, they can't bring up new evidence.

so let me go here. So, you have to do a
a a whole another hearing and go back to
the the the trial court with another set
of merits. And it has to be
constitutional. It can't be
discretionary.

in the courtroom, that's the judge's
discretion.

judge probably going to ship him off

hope in his heart and come back down

Carter speaking on behalf of the Austin
Medv Foundation says the focus now
should be preventing another family from
experiencing this kind of loss.

foundation can save one group of kids
and families from this pain, I'm all in.

the 29th district court of Colin County,
Texas order denying denying new trial uh
on the August the 20th 21st 2026. It
said it came to be a a her defendant
motion for new trial upon the evidence
of the arguments. You know what I mean?
and and it say reviewing the motions,
the recording of the briefs and the
relevant case law, the court has
determined that the motion should be
denied and therefore considered
therefore the a judging uh a judge by
the court of the motion of a new trial
is denied. Signed August the 22nd. Mr.
Chitty himself signed this man. He ain't
gonna let him out.
He ain't gonna let him out. They had a

It's just sad because now now he got to
be shipped back down and it's just
