Video summary

A new judge in Texas has officially denied Karmelo Anthony's motion for a new trial, leaving his murder conviction and thirty-five-year prison sentence intact. The ruling, issued by Judge Michael Chitty following a two-day hearing, was based on a brief one-page order that cited a review of the evidence, arguments, and relevant case law without providing specific reasons for the decision. Anthony's legal team had argued that his right to a public trial was violated due to a lack of an overflow courtroom and access issues, as well as claiming that an informal agreement between prosecutors and former defense attorneys regarding the scope of testimony had been breached. Despite these claims, the court determined that the motions lacked merit and were largely matters of judicial discretion, resulting in a denial that has sparked significant frustration among Anthony's supporters and family. The reaction to the decision highlights deep divisions within the legal community and the public regarding the fairness of the proceedings. While some observers suggest that the new judge may have been influenced by his predecessor or simply lacked empathy for the defense's arguments, others point out that the original issues raised were procedural rather than constitutional. Critics note that the prosecution's questioning of teenage witnesses about whether their actions constituted murder was improper but failed to meet the high bar required for ineffective assistance of counsel under *Strickland v. Washington*. Furthermore, the inability to introduce new evidence in an appeal means that Anthony's legal team must now focus on finding a different angle or potentially seeking relief from a higher court, a difficult path given the established facts and the judge's firm stance. Beyond the courtroom drama, the tragedy of the case continues to resonate with both families involved, emphasizing that there are no true winners in this situation. Pastor Bruce Carter, speaking for the Austin Metaf Foundation, stressed that while one family suffers from the loss of their son, another faces a lifetime behind bars, and the focus should be on preventing similar tragedies in the future. The conversation also touched upon the broader societal impact, with some arguing that the legal system has failed both parties by allowing a life to end and another to be ruined, even if one party was acting in self-defense. Ultimately, the denial of the new trial marks a significant setback for Anthony's efforts to overturn his sentence, leaving him to serve the remainder of his term while his supporters continue to fight for justice through appeals and public advocacy.

Yeah, we on Boss Talk TV. Shout out to E. The reason you see >> Meat stabbing case late this afternoon, a judge denied Carmelo Anony's request for a new trial. Thanks for joining us everybody. I'm Terresa Woodard. Anthony in June was convicted of murdering fellow Frisco ISD student Austin Metaf. The stabbing happened in April 2025. Today's ruling came down about 3 hours ago. In a one-page document, the judge said upon reviewing the motion, the record, the evidence and argument, the briefs, and relevant case law. The court has determined the motion should be denied. Senior crime and justice reporter Rebecca Lopez has been in the courtroom following this case really from the very beginning. Rebecca, you've been talking to both sides since this decision came down. What are you hearing? >> So, Teresa, this decision basically leaves Carmemelllo Anony's murder conviction and 35-year sentence in place. And tonight we are hearing reaction from Anony's attorneys and the Austin Metev Foundation. The judge denied Anony's motion for a new trial after two days of testimony. Anony's new attorneys argued his right to a public trial was violated because the original judge did not provide an overflow courtroom and more access for the public. They also argued an informal agreement between prosecutors and Anony's former attorneys fell apart, affecting the decision not to have Anthony testify. The two sides had agreed to keep damaging information about both Anthony and the Medv twins away from the jury and focus only on what happened the day Austin was stabbed. >> Wow. There you go, guys. Denied. Denied. Denied. These guys, they went in there, they got the judge taken out of out of the the new judge may have been friends with the old judge. I don't know. But this is a denial that has shook up the judicial system when it come down to the Car Carmelo Anthony family. OG, are you there? >> Well, I told you from the beginning that uh their their merits were weak and I uh denied access to a public trial. He didn't the judge didn't deny access to a public trial. the people came in who he wants in the courtroom is the judge's discretion. Uh the deal that the prosecution made with the defense to only talk about that time. That's discretionary. We should the the motion should have been on his civil rights, his rights being violated, which they didn't bring up any of that. From the time that the prosecution had the teen witnesses on there and he asked them for a conclusion, do they think that was murder? That's not what you ask a witness. That's not what a witness a witness is not a professional. They they can't deduce what's man's slaughter and what's murder. So for me to ask you, do you think this was man smart or murder? And I say it's murder. That's tighten the jury. And when the judge did not uh sanction the the prosecution on that and you didn't and the um defense didn't uh ask that it be stricken. That's called under Lel versus the state of California. It's called ineffective aid and counsel. So yeah. No, they den they denied stuff because it had no merit. >> Well, they I I think they knew that that this was going to be an uphill battle. Just because you get a new judge in the same county that was working side by side this other judge the whole time. What make you think things are going to change so uh instantaneously. This is a uphill battle. >> Yeah. That's just like they telling uh well we going to fire uh Boss Char, but we going to hire OG. It's still going to be the same rules. >> Yeah. Well, yeah. What you what you think the difference going to be? >> It ain't going to be no different. And that's the whole game. >> So, you have to you have to deal with merit. And when you go in there, that was a a those were were weak uh motions to begin with because with with those kind of motions, you know, that's discretionary. That's that's not something that holds standard that would show that it would be any different on the outcome of the case. How many people in the audience? What was that going to sway the jury? >> It's sad because it's sad because they didn't take long to do it either. >> No, not long at all. Because it was already embedded in their mind. When you have three witnesses, teen witnesses that claim that they were on the scene and when you testify to what you know happened and when in the conclusion I asked you, do you think that was man manslaughter? Do you think that was accident or intentional? And you say it's intentional. So what is the jury to think? >> Yeah. Judge Michael Chitty, that's his name, Michael Chitty denied the trial retrial motion in a halfpage order following a two-day hearing this week near Dallas citing reviewing the evidence arguments he did not elaborate on. He didn't even give them an a reason why >> Russell Wilson Anony's attorney said the defense would appeal, you know, but but but he didn't give him no kind of explanation on it. Uh Mr. Witty was not trying to pity nothing that was going on with this trial. And it's like, >> no, but >> you know, he he said Mr. Chitty >> Mr. Chitty had no pity. >> But you can't fault you can't fault the judge because the merits were low. >> So wait, wait, wait a minute, though. Just stop. I'm I'm g I'm gonna go on and let me let me let me quit you right now from doing that. Okay. And and I hate to bust your bubble, but no, let's get let's get this straight. >> These guys have been to school forever. They went in there. They went in there and they did what they felt they had to do. This is a team of legal attorneys that have been in this forever and you come on here. Maybe there's a reason. Maybe there's a reason. Listen, maybe there's a reason why they just this just did it this way. >> Yeah. Because they cop out Charlies. They just like Mike was a his attorney. cop out Charlie. >> Yeah. His his attorney that he had that got him in prison, went to school for years. So your your argument is weak and mute. >> No, I'm telling you right now, man. Those guys right now, this might be a minor setback for a major comeback. I get it. They trying to figure out a way. They They trying to figure out a way to Listen, man. They trying to figure out a way to make this happen. >> How is you such a mind reader? I ain't figuring OUT [ __ ] YOU MAN, YOU YOU mad because that man is part of Ben Crump's team and he has a a a partnership. >> The the the one that's on Ben Crump team is a female. >> She is a female, but she's associated with the man that's working on this thing and she has influence, too. So, all I'm telling you is all I'm telling you is why do you think that they did it? Okay, I get it. We didn't get the answer we wanted. >> We didn't get the answer we wanted and I get it. But do you think now that they can turn around and maybe make a decision in this appellet court, maybe they knew that they wasn't going to be able to get nothing to go through this guy? >> No. Because now going to the appellet court, they can't bring up new evidence. You can't just Okay. Well, I tried this, so let me go here. So, you have to do a a a whole another hearing and go back to the the the trial court with another set of merits. And it has to be constitutional. It can't be discretionary. >> Oh, it wasn't enough people let into the jur uh into the to the courtroom. THEY HAVE SIGHTSEERS. IF I DON'T WANT NOBODY in the courtroom, that's the judge's discretion. >> [ __ ] Good lord. Hell no. OG, you got to see this one. Oh no, sir. Oh, hell no. OG, let me send this to you. Right. Good googly goo. Woo. OG. Sometime you can look at a situation. Something Ray Charles can see when Stevie want to point at it. Man, take a look at that picture. That judge Chitty right there. >> I ain't looking at nothing. >> Boy, look at Chitty. Chitty don't look like he f to be. I would you. Boy, Mr. Chitty was not fit to hear that. I'mma tell you that right now. >> Oh. Oh. Oh. Man looking LIKE COLONEL. >> MR. CHITTY WAS not to hear that. Mr. Chitty don't look like he was putting up with no pity, [ __ ] >> No pity with Chitty. >> No pity with Chitty, man. No, sir. >> You know dang well >> I could look at him and tell. Don't even go in there. >> Don't even not >> with that one. >> It went They went Hey, that younger dude would have been He did his dude. He That's who's that's who THAT'S WHO TOLD HIM TO DO IT. Oh no. This is not good. OG, >> that's who told him to do it. >> That's who told Look at him. What you think? >> I already know. I already know, >> man. Look at that up. Look, they got my boy stand sitting beside him. You knew what he gonna do to him. What you think he gonna do to him? Look at that [ __ ] I just sent you. What do you think he's going to do to Carmelo Anthony? >> That is not his white daddy. >> Chitty had no pity, man. And I'm telling you right now, man, this is not good, man. But I one thing I can tell you is that going through this experience now, he had to they they brought him back. They brought him back to court. Now he got to go back hopefully go back to the same unit and they don't switch his unit on him cuz sometime when you get shipped back, you'll go back to a different unit because you got Now you got now they probably holding him in there cuz they you you know this this judge probably going to ship him off quick. You know what I mean? They they they going they gonna probably end up uh shipping him out of there. >> And and and that's so frustrating for him to come leave that situation with hope in his heart and come back down there and now you got to go back like oh my goodness. You know that that's stressful. >> Yeah. Chitty I I could have told him though Chitty was Chitty is not going to be the one to uh help these boys. This boy man. No, I don't see Chitty helping nobody. Now, let me listen to a little bit more of this. OG Chitty J. I just >> The Medv family isn't commenting on the judge's decision today, but Pastor Bruce Carter speaking on behalf of the Austin Medv Foundation says the focus now should be preventing another family from experiencing this kind of loss. >> Someone's child is in the grave and another person's child is facing 35 years. There are no winners. And if this foundation can save one group of kids and families from this pain, I'm all in. >> What do you think about the pastor and what he had to say there? Og. >> Why you getting quiet now? This is a fellow brother. This is a pastor. He spoke out. He said he told you the same thing I told you months ago. >> That you you just like him and just like I told you when you said it months ago. I said the same thing. >> Bould you remember? I'm glad you remember. >> OG OG. It's a tough It's a tough call, man. There a lot of people hurting behind this and I told you that early on. I know you don't like to hear it, man. But man, that man is gone. One man is gone. >> And one man is here, man. It's a tough call, man. >> That young boy's life is ruined because y'all allowed it. That's it. That's >> Who the hell is y'all? >> You You all >> No, no. Let me tell you something, OG. I'm not I'm glad I'm glad you I'm glad you said that. I'm so sick of you trying to put that on somebody. Ain't nobody did nothing but try to stand there. You seen the people coming into town. You seen everybody here. Everybody was out there trying to trying to stand up for What do you want from us, man? >> And that's just we just standing there like, >> "What do you want from us, man?" >> A bunch of cigar engines just standing there. >> Man, I ask you, what do you want, brother? You >> see what the jiujitsu system thought about y'all standing? Keep on standing because it's going to start raining. Man, I'm telling you this is like that like that uh uh that pastor just said, man, everybody there's no winners in this. There's no winners in this. >> YES. WHITE WHITE AMERICA'S a winner. >> No, there's no winners in this. You got a man that lost his life and you got another man that's doing 35 years in prison. I told you this months ago, man. >> You have a man that gave his life away trying to be a bully and you got a brother that got >> and I don't deny that. But the people who pretty much his family and stuff, they they're the ones suffering behind the loss of this guy. Man, >> they they ain't suffering. They just sued the school for $20 million. >> OG, you just talking. Don't you dare sit up there and act like this ain't hurt both parties, man. You know, I I I hate when you do that, man. >> It ain't hurt nobody but us. >> You really think that way or you just saying that? >> I wouldn't say nothing. I didn't believe. Wow, man.
