Okay, this is MXUX. In this video, I'm going to try to get to the bottom of this Tesla National Highway Transportation Safety Association kurfuffle. I smell a rat, but let's just get started. I'm just going to go through a couple articles here to give you a little background. Uh this is electric which has always been a Tesl Tesla bash basher forever. Okay. Forever. Um orders Tesla to prove it cyber cab is legal to sell under oath. Um ordered Tesla to prove it cyber cab is even legal to sell. The agency issued a formal special order on 10. So this was hours after Tesla has until September 30 to respond. Filling the answer fully and truthfully carries penalties up to 139 million. Um this is 21 detailed questions. Okay. Head of litigation and general counsel for regulatory affairs. So they're saying uh that uh Tesla self-certified. This is how you know homologation and other things work. The companies have a rule book that they follow and then they basically say we met all the rules and then Nitsa uh reviews it and if they have a problem they do this. Here's the thing. There's a big timing problem here. And to make a long story short, uh they were quick hours to to make these charges against Tesla's Cyber Cap. Zuks uh had the same issues months before Nitsa approached them. Okay. And here's the real rub. If Tesla, if Tesla was treated the same way Zuks was, technically by the time uh they would have wanted to investigate Tesla, the new laws would have been into effect that would have made 90% of this moot. So, uh, anyway, in plain terms, the agency is asking Tesla to defend a certification it suspects, it suspects can't be defended. This is a gotcha. As I said, there is a pending rule that's already, and we're going to go over this in a minute, it's already been written and is up for public comment. They even extended public comment. I suspect to get more negative comments and it's supposed to be enacted. Once it's in enacted, it'll go into effect immediately. 90% of this is going to be moot. I would say all of it personally. Um Tesla does not have an argument. Okay. And and Nitsa clearly anticipates it. Yeah. They don't have an argument because the new law was supposed to be in effect. The new law that's already been written that's been open to public comments that just needs to be given the green light by Nitsa isn't in effect. So presses press is the company on which standards don't apply with no driver theory that written for human operator meant blah blah. You can't hold a robot taxi to mirror adjustment turn signal rules without a person. This is all ridiculous on the face of it. If these new laws, these new regulations by Nitsa weren't already they they're they're they're done. Every all the comment, all they need to do is put them in place. If they were in place, this wouldn't even be an issue. And especially the main issue, the footbreak problem, which the new rules totally nullify. So, uh, the the thing is this smells of a See, Zuks did it the other way. We're going to go over this in in detail in a minute. This smells of a a political operation before the midterms. In my opinion, it's ridiculous on the face of it. Uh, I think this new head of Nitsa, you know, maybe he's a button-down guy and he's just following the letter of the law, no matter how ridiculous it is. But anyway, here's another piece. This is in on Yahoo. Nitsa demands answers to 21 safety questions by month end. You know, really, by month end, this new law should be in effect. They ended public commentary in July. This is re so ridiculous. This is so ridiculous. Uh under the order Nitsa's chief counsel detailed request under the uh blah blah blah. So the order stated response to come under oath from a Tesla officer. So, you know, are they are they trying to hang uh Musk out to dry on this? Uh if Congress goes the other way on the midterms, they sloww walk this investigation, which they can slow walk it for years. Will they um put another Tesla official on the hook uh and try to charge him with perjury and use lawfare? uh uh weaponize the financial system, weaponize the SEC, weaponize Nitsa, you know, I don't know. But we're going to go into this. Let's just take a look at who this guy is, and then I'm going to go over some detail on why I think uh this really stinks. Okay, so this is what the chief counsel, this is what he looks like. Um, Harvard Law, Peter Sims Shower, thousand followers. He's got some PR stuff here. Um, chief counsel, compliance officer. This is um related to autonomous driving. Um, corporate law. Uh, interesting. Harvard Law, Obama ter I mean Obama territory here or Bana Illinois. So Illinois is what we say back in my hometown. Anyway, uh this is what the guy looks like. not a tinge of trying to tell what his political ail affiliations are, although a math and engineering background and a law background. So, certainly he has a a tech background and uh a smart guy. Okay. So, I'm I'm looking into these Tesla charges and you know, I smell a rat, but I can't find one. But um the uh head of the uh National Highway Transportation Safety blah blah blah uh is a Harvard law guy and uh he worked uh corporate before this. No known political association as a Democrat or Republican. So, he hasn't worn his uh output, his uh political views on his sleeve. Um, this smells of a, you know, Democrat uh scop. I mean, right before the midterms. And and I'll tell you, I still have my uh questions about this, and I'm going to show you this in a minute. the timing of this uh this is the guy's name Peter Simhauser. Okay. And appointed uh as part of the Trump Vance. So Trump appointed him again. Um he's the chief counsel. So I don't know if Letic would have cleared him uh as a Trump loyalist. Uh, not to overly politicalize this. This is not a political channel, but let's just call a spade a spade. Musk is going to donate or is donating 120 toward million towards the midterms. And uh there's nothing the political opposition would rather do than ruin must business and put him in jail. and they're going to make somebody testify under and we're going to we're going to go over this in a minute. Testify to this under oath and face potential to explain how they self-certified when they knew it broke the rules and under oath with the threat of $140 million fine or I think that's might be daily but anyway it's irrelevant. There's potential jail time for this uh longtime partner. See, there's no uh compliance. So, he's chief uh compliance officer at Motional, an autonomous vehicle joint venture. You know, he has worked for a number of uh self-driving competitors in one function or another. I don't know if that has anything to do with that. Uh, his current position ties in the Republican Trump administration as a political appointee, but there's no available evidence of a personal Democrat or a public Republican affiliation beyond that. Now, here's the thing. Um, this is not a stop. It's an investigation. But look at this timing. On September 3, Tesla began the Cyber Cab. uh commercial rides in Austin hours later, hours. Okay. The open the audit query. Okay. Within hours and then within days escalated to a formal special offer signed by chief counsel. It it requires test to answer 21 detailed questions under oath facing financial and criminal penalties for lying as they define it uh by September 30 explaining how a vehicle without conventional human controls meets standards written for vehicles with them. Non-compliance carries potential civil penalties uh up to roughly 139 million. I do I I do believe perjury applies uh which would be criminal. Now this is the thing you know if you know homologigation and self-certification and all that stuff the car manufacturers do this themselves and then the National Highway Transportation Safety Administration goes over everything. Okay. Um usually it's kind of a rubber stamp. Uh uh yes blah blah blah afterwards many standards uh now this is what they're looking at the violation is on service brakes activated by a foot control plus rules on steering mirrors and related uh uh equipment. Tesla certified the cyber cab as compliant anyway although it doesn't have any of these things. uh treating certain requirements as in accept uh inacceptable to fully driverless design. Um that says certifying whether that was proper under current law. Now we're going to see in a minute they got a law that's pending that's passed the comment period in August that's supposed to go into effect that basically makes all these things legal. Okay. So the timing of this, you know, within hours and within days appears to me uh to to fast track this. I think when Tesla uh did this self-certification, they assumed and I think rightly so or pretty close to rightly so that these new rules would be in effect by the time uh they self-certified. Uh Nitsa is sloww walking. They fastwalked the the investigation into Tesla and they're sloww walking the approval of these rules. And it seems like a uh sciop politically motivated uh action to me although I don't know how many levels you would have to go down to find any uh political motivation. Uh in in short, Simhauser is enforcing exist existing federal safety standards uh via investigation and sworn information, not stopping the deployment. But uh was he in charge when Zuks went through the same issues? He was not. But he was in charge when Zuks got their uh permit to operate. Uh, now here's the thing about J Zuks. Long story short, July 22, Zuks announced uh that they they had the the Zuk's vehicle and they were running it around. It wasn't until September, July, August, September, three months later, uh, Nitsa issued a special order demanding Zuks explain. And then uh it was you know a year later that uh Nitsa opened an audit query which they have immediately opened on Tesla. Okay. Now the investigation continued for years under prior Nitsa leadership but you can see this timing is very suspect to me. Um Duke's got an a exemption which allows it to operate 2500 cars. Um in 20 August 2025 uh Nitsa granted Zuks a demonstration exemption and closed. This occurred while Sa Hello. Oh Amazon. This occurred while uh Simhauser was chief counselor. He later publicly referenced Nitsa issuing the first exemption for Americanbuilt driverless vehicles. He has a ton of experience as I said with driverless vehicles. And so the point here is is uh this timing. Now here's the thing. No final rules have been issued yet. There is no effective date. When will the new pending rules? There are pending rules. Uh the new self-driving rules are a series of proposed amendments to existing federal motor safety vehicle standards. Existing standards remain fully enforced. Key proposals as of September. Uh the po the point is uh this is as of September as of this month. This is the new rule that's pending that's gone through the comment session. The the comment session after which they're supposed to uh they extended it from July to August 2026. Okay. So again sloww walking this approval of this rule which makes this investigation against Tesla moot light vehicle brake system proposed would remove the requirement for footnote or hand operated brake controls on vehicles designed exclusively for automated driving. So, uh, based on the Zuk's actions, Tesla could have reasonably assumed that this rule would have been in effect by the time they launched the cyber cap. And in fact, I technically there is no reason for this rule not to be in effect right now. Um, but they're they're considering uh comments. The thing is fast walk the Tesla uh charges. Slow walk this new implementation of the rules. Okay. and slow walk you know Zuk's got a break and was able to operate for months if they would have given Tesla the same consideration that Zuk's got by the it should be by the time that this came around this new rule would be in effect after the comment period's closed Nitsa review submissions may revise the proposal and issue the final rule uh Okay. Propose an effective date, sometimes immediate for for deregulatory changes that remove requirements. This is this is exactly what the case is here or 30 or 100 days later. So once this new rule went into effect, it it should have been immediate. And no public timeline has been announced for the finalization of any of these rules. as of midepptember. None have been f finalized. Uh rulem typically takes months after the comment period ends. Uh they extended that comment period to uh July, August, September. It's months. Okay. So this this really the proposal pending existing uh rules including footbreak requirements continue to apply. So you can see what I'm talking about here. Um this was accelerated to hours where Zuks had months before they were approached by Nitsa. Um, if and I think that Tesla u and Musk likely looked at this pending rule, looked at what the status was, looked at the past history and reasonably assumed that this rule would be in effect by the time uh actually before they they they assumed they could launch the cyber capab and then prior to any investigation, the rule would be in effect and it would be immediately implied and would be the end of the story. Uh, as far as the braking goes, I don't know. the the steering and the mirrors are are are different. But the po the point is this whole thing to me looks like um some kind of scop. I don't know. I think uh this uh needs to be investigated. Um I don't know. There's something is definitely not right about this. Uh, no public timeline has been announced for finalization of any of these rules. Okay. Rulem typically takes months after the comment period ends. Okay. All these parameters have been met. These rules should be put. Let's see what happens. But I'm going to tell you, they are going to risk criminal con, you know, perjury charges. um they can get flims flammed into criminal charges related to this and certainly if they make must testify and put him on the petard on a you know the damocles sword of uh making him defend his cyber cab decisions while explaining the self-certification. Ah this really stinks. Okay. Um, I think it's I I don't know. This guy, as I said, he worked for a lot of self-driving competitors, corporate entities. Um, I don't know if that has if he has any association with the other parties here or in some international parties. I don't know if there's a conflict of Memphis. It's very odd that let me just duh think about this. Zuks did the same thing Tesla did. They weren't approached by National Highway Traffic Safety Association for months. Months. Okay. They operated for months. Tesla's up hours. probably an hour after they were up in Austin, uh, Nitsa comes after him. Okay. Now, again, there are pending rules that are going to make most of, if not all of this argument moot that the National Triway Highway Safety Administration, the case it's making is based on rules that are going to be moot for the most part if these new laws pass. And these new laws have already they've gone through the entire process. All they need to be is enacted and they will likely go into effect immediately. So I don't this is a show trial. This is um I don't know. This is like uh you know this is like cultural revolution in China. You know let's bring the landlords up and and make them confess to their sins. I don't know what's going on here. I would love to know um where Trump stands on this. Um uh obviously I think uh the most favorable outcome would be to have um the Trump administration win the midterms because if um the opposing party gets into power. I mean, this could be uh you know, I've done many videos on I call it the uh Lordstown Motors Playbook, and you can see my catalog on this. I I want to tell you that company was dismantled as I called it a blue swan. Okay, you know, black swan is a totally unexpected economic blue swan is a politically motivated attack that weaponizes the financial system, weapon weaponizes the SEC, we weaponizes the National Highway Traffic Safety Administration, weaponizes short sellers like Hindenburg, uh uh Soros, all of these factors go in and not only do they want to destroy a company, they want to put the founders in jail. That's what they really want to do. And it's a zero- sum game. And uh let me tell you, uh Lordstown Motors was attacked because it was a pet project of Donald Trump and the attack didn't take full steam until the opposition party took the presidency. So, I hope this isn't a preamble to the uh Lordstown playbook for Tesla. Certainly, if the opposing party gains enough seats to control Congress after the midterms, uh this could be uh very bad. So, I'm going to ask all the Tesla, not a political channel, but you know, Tesla shareholders, you you need to vote. Uh, and um I think someone needs to be asking questions about these the timing of these events. And um I don't know, like I say, I've done a did over a hundred videos on the Lordstown Motors Playbook. This is something that happens. You don't think it can happen in America. The entire legal system, the entire financial system, the entire regulatory system can be weaponized by political opposition. You call it the deep state, call it I call it a blue swan. And I I hope that is not the case here. I'm hoping this guy is just a button-down Harvard lawyer following the letter of the law and as soon as this uh uh regulation is approved that this is all going to be moot. However, if all that stuff is slowwalked, okay, as it appears to be happening right now in perfect conjunction with the preamble to the midterm elections, I am very suspicious about all of this.
